How Overseas Pakistanis Can Buy Property Remotely

How Overseas Pakistanis Can Buy Property Remotely

  • By Muhammad Usman
  • Real Estate

Disclaimer: Property law, tax rates, and digital services referenced here change periodically and vary somewhat by province. This article reflects publicly reported processes as of 2026. Confirm current requirements with a property lawyer and your bank before committing funds to a purchase.

Buying a house or plot in Pakistan used to mean flying home, sitting in a lawyer’s office for days, and hoping nobody back home mishandled your paperwork while you were gone. That’s genuinely changed. Between digital power of attorney, dedicated overseas banking channels, and online land record verification, an overseas Pakistani can now complete a property purchase from another country without stepping foot in Pakistan. Here’s how the process actually works, where the real risks sit, and what to check before you send a single rupee.

The Three Pieces That Make This Work

Buying remotely rests on three tools working together, and skipping any one of them is where most remote purchases run into trouble.

  1. A valid NICOP or POC, which establishes your legal standing to own property in Pakistan
  2. A Roshan Digital Account, which gives you a regulated banking channel to move funds and complete the transaction through official channels rather than informal transfers
  3. A properly attested Power of Attorney, which lets someone in Pakistan sign documents, handle the registry office, and represent you at every step you can’t be physically present for

Get these three in place before you start seriously shopping for property, not after you’ve already found something you want to buy.

Step by Step: Buying Property From Abroad

  1. Set up your Roshan Digital Account first. Most banks require this before you can move funds into a property transaction through an official channel. If you haven’t opened one yet, this is the first thing to sort out.
  2. Get a Power of Attorney issued. NADRA, working with the Ministry of Foreign Affairs, runs an online Power of Attorney system at poa.nadra.gov.pk that lets Pakistani citizens abroad apply without visiting an embassy in person. You’ll need your CNIC, NICOP, or POC, along with identity documents for your attorney and witnesses. A Special Power of Attorney limited to one transaction is generally safer than a broad general one, since it limits what your representative can do on your behalf.
  3. Research the property and verify its legitimacy. Ask for the fard (record of rights), allotment letter, and intiqal (mutation) record. Confirm the specific phase, block, or tower is approved by the relevant development authority, not just the wider housing society name.
  4. Engage a property lawyer in Pakistan, separate from whoever holds your Power of Attorney if possible. A lawyer can run forensic checks on title documents and flag forged signatures or disputed ownership claims that a family member acting informally might miss.
  5. Complete the transaction through your RDA. Payments routed through Roshan Digital Account channels, including options like the State Bank’s Roshan Apna Ghar financing product, keep the transaction documented and bankable rather than relying on informal hawala style transfers.
  6. Your attorney signs the sale deed and completes registration at the relevant Sub Registrar’s office. This is the step that legally transfers title, and it’s also where your attorney’s authority under the Power of Attorney matters most.
  7. Confirm mutation (intiqal) is filed so the property record updates to reflect you as the new owner, not just the sale deed itself.
  8. Get certified copies of the registered deed and mutation record sent to you for your own file. Don’t rely solely on your attorney’s copy.

Roshan Apna Ghar: Financing Without Flying Home

If you want financing rather than paying the full amount upfront, the State Bank’s Roshan Apna Ghar product is built specifically for nonresident Pakistanis and POC holders buying, building, or renovating property remotely. Banks can finance up to 85 percent of a property’s value for purchase or construction, and up to 30 percent for renovation, with terms running from three to twenty five years in both conventional and Shariah compliant structures.

The catch worth knowing about: while the financing agreement itself can be signed digitally, obtaining the property’s title documents from the Registrar and creating the bank’s charge on the property still requires either your physical presence or a Power of Attorney authorizing someone in Pakistan to handle that step. Pakistani missions abroad have set up priority processing for attesting these Special Powers of Attorney specifically for RDA holders, which speeds up what used to be the slowest part of the process.

Getting the Power of Attorney Right

A Power of Attorney is the single document most remote property purchases hinge on, and getting it wrong causes more problems than any other part of this process.

For Pakistani citizens holding a CNIC, NICOP, or POC, NADRA’s online system lets you complete the application digitally: you submit identity documents for yourself, your chosen attorney, and your witnesses, then select your nearest Pakistani mission for the attestation step. Foreign nationals without one of these Pakistani identity documents generally still need to visit their embassy or consulate in person after getting documents attested by their own country’s foreign ministry first.

A few practical points worth acting on:

  • Use a Special Power of Attorney limited to one property or one transaction rather than a broad general authorization, unless you have multiple ongoing matters in Pakistan and full confidence in whoever holds it
  • Choose your attorney carefully. This is often a family member, but a property lawyer acting as your attorney adds a layer of professional accountability a relative may not be positioned to provide
  • Keep the scope narrow and specific. Vague or overly broad language in a Power of Attorney is one of the more common sources of disputes down the line

Verifying the Property Before You Commit

Fraud risk is the honest reason many overseas Pakistanis hesitate to buy remotely, and most of that risk is preventable with the right checks before money changes hands.

CheckWhat it confirms
Fard (record of rights)Current recorded ownership of the property
Allotment letterOriginal allocation from the development authority or society
Intiqal (mutation) recordWhether ownership has been formally transferred in official records
NOC status of the phase or blockWhether the specific section of the society is approved, not just the society’s name generally
Developer account cross checkWhether payments actually reach the developer rather than an intermediary

None of these checks are optional if you’re buying in a housing society or development project rather than an already registered individual plot. Fraud involving unapproved phases or blocks within an otherwise legitimate sounding society name is a recurring pattern worth taking seriously.

Tax and Legal Details Worth Knowing Before You Buy

A few things intersect with the buying process that are easy to overlook from abroad:

  • Filer status affects your advance tax rate. Buyers registered as active tax filers pay meaningfully less under Section 236K than non-filers on the same transaction. Overseas Pakistanis buying through an RDA channel can access filer level rates on the specific transaction even without being on Pakistan’s Active Taxpayer List, provided the purchase runs through a documented nonresident banking channel.
  • Provincial stamp duty and registration fees vary. These are mandatory and collected at the point of registration, and rates differ by province, so factor this into your total budget rather than treating the purchase price as the full cost.
  • Benami ownership rules restrict holding property in someone else’s name. Structuring a purchase to disguise the real owner carries legal exposure under Pakistan’s benami property law, so a properly executed Power of Attorney in your own name is the compliant route, not an informal arrangement where a relative holds title on your behalf.
  • Get a Foreign Remittance Certificate for funds transferred in. This documents your remittance for tax purposes and matters if you ever sell the property or need to demonstrate the legitimate source of funds.

Frequently Asked Questions

Do I need to visit Pakistan at any point to buy property?
No. With a Power of Attorney, an RDA, and a lawyer or trusted representative handling the registry step, the entire process can be completed without traveling.

Is a Power of Attorney the same as owning the property jointly with my attorney?
No. A Power of Attorney only authorizes someone to act on your behalf for specific matters you define. It does not transfer ownership or give them any personal claim to the property.

What happens if my attorney in Pakistan mishandles the transaction?
This is why choosing your attorney carefully and using a narrowly scoped Special Power of Attorney matters. A professional property lawyer acting as attorney, paired with a separate lawyer reviewing the transaction independently, reduces this risk compared to relying on one family member for everything.

Can I finance a property purchase from abroad instead of paying in full?
Yes, through products like the State Bank’s Roshan Apna Ghar, available to nonresident Pakistanis and POC holders through participating banks, with financing available for both purchase and construction.

How do I know if the housing society I’m buying into is legitimate?
Check whether the specific phase or block has NOC approval from the relevant development authority, not just whether the society’s overall name is recognized. Many disputes involve unapproved sections within a legitimately named society.

If you’re ready to move forward, start with the two things that take the longest to set up: your Roshan Digital Account and your Power of Attorney. Getting both in place before you’ve picked a property means you can move quickly once you find one worth buying, rather than watching a good deal slip away while paperwork catches up.
